{"id":5165,"date":"2013-01-04T08:23:51","date_gmt":"2013-01-04T13:23:51","guid":{"rendered":"http:\/\/stephenlirakis.com\/?p=5165"},"modified":"2013-01-04T08:23:51","modified_gmt":"2013-01-04T13:23:51","slug":"oracle-fined-breaking-thier-rules","status":"publish","type":"post","link":"http:\/\/stephenlirakis.com\/?p=5165","title":{"rendered":"ORACLE FINED, BREAKING THIER OWN RULES"},"content":{"rendered":"<h1>Team Oracle \u201cSpy\u201d Penalities<\/h1>\n<div>\n<div>December 31, 2012<\/div>\n<p>By\u00a0<a title=\"Posts by mrmojo\" href=\"http:\/\/www.mojosail.com\/author\/mrmojo\/\" rel=\"author\">mrmojo<\/a><\/div>\n<div>\n<div id=\"wp_fb_like_button\"><iframe loading=\"lazy\" id=\"fa5bf66a4\" title=\"Like this content on Facebook.\" name=\"f1db94dadc\" src=\"http:\/\/www.facebook.com\/plugins\/like.php?api_key=&amp;locale=en_US&amp;sdk=joey&amp;channel_url=http%3A%2F%2Fstatic.ak.facebook.com%2Fconnect%2Fxd_arbiter.php%3Fversion%3D18%23cb%3Df9500569c%26origin%3Dhttp%253A%252F%252Fwww.mojosail.com%252Ff29d63876%26domain%3Dwww.mojosail.com%26relation%3Dparent.parent&amp;href=http%253A%252F%252Fwww.mojosail.com%252F2012%252F12%252F31%252Fteam-oracle-spy-penalities%252F&amp;node_type=link&amp;width=400&amp;font=arial&amp;layout=button_count&amp;colorscheme=dark&amp;action=like&amp;show_faces=false&amp;send=true&amp;extended_social_context=false\" scrolling=\"no\" width=\"320\" height=\"240\"><\/iframe><\/div>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.mojosail.com\/wp-content\/uploads\/2011\/12\/scales-of-justice.jpg\" alt=\"scales of justice\" width=\"150\" height=\"137\" \/><br \/>\nThe America\u2019s Cup Jury has announced the \u00a0penalties for Team Oracle\u2019s \u201cspy mission\u201d against Luna Rossa.<\/p>\n<p>Luna Rossa claimed Oracle violated the so-called \u201cespionage\u201d clause of the race protocol (more on that\u00a0<a href=\"http:\/\/www.mojosail.com\/2012\/11\/28\/busted-luna-rossa-files-spy-protest-against-oracle-2\/\" target=\"_blank\">HERE<\/a>), the Jury agreed, and told Oracle it would be penalized, fined, and made to return any photos.<\/p>\n<p>According to Jury documents, Oracle returned 10 photos (no videos).The fine was set at E 11,500, and Oracle won\u2019t be allowed to sail either of their AC72s for five days at the end of the next sailing period (Feb 1 to May 1 \u2013 in other words, Oracle can\u2019t sail 26 April to 30 April 2013)<\/p>\n<p>Both Luna Rossa and Emirates Team New Zealand asked for much stiffer penalties: Luna Ross said a \u201cfinancial penalty would be meaningless\u201d, and asked the Jury to reduce the number of sailing days from 30 to 15 between February and May, make Oracle give up two spare daggerboards and one wing.<\/p>\n<p>ETNZ gave the Jury a smorgasbrod of penalties to choose from \u201cA loss of a point or points in the Match\u2026 a reduction of Wing Spar Sections\u2026 or permitted Daggerboards\u2026 a reduction in permitted sailing days\u2026.\u201d and an order of no more \u201crecon\u201d missions.<\/p>\n<div id=\"attachment_7476\"><a href=\"http:\/\/www.mojosail.com\/\"><img loading=\"lazy\" decoding=\"async\" title=\"return\" src=\"http:\/\/www.mojosail.com\/wp-content\/uploads\/2012\/01\/return.jpg\" alt=\"\" width=\"100\" height=\"75\" \/><\/a>Back To Main Page<\/p>\n<\/div>\n<p>Here\u2019s what the jury had to say:<\/p>\n<blockquote><p>29th December 2012<br \/>\nJURY CASE AC19<\/p>\n<p>JURY NOTICE JN060<br \/>\nDECISION on PENALTY and COSTS<\/p>\n<p>APPLICATION from Luna Rossa Challenge 2013 (LR), representing Circolo della Vela<br \/>\nSicilia.<\/p>\n<p>1. On 19th November 2012, the Jury received an Application from LR protesting \u201cthe<br \/>\nDefender, Oracle Racing, GGYC\u201d (OTUSA) for a reconnaissance incident on 8th<br \/>\nNovember in the waters off Auckland, New Zealand, claiming a breach of Protocol<br \/>\nArticle 37.2(g).<\/p>\n<p>DIRECTIONS No. 1 (JN053)<\/p>\n<p>2. On 21st November 2012 the Jury issued Directions No.1 inviting the Parties to<br \/>\nsubmit a Response to the LR Application by 5th December 2012, and inviting LR to<br \/>\nsubmit a Reply to any Responses, by 12th December 2012.<\/p>\n<p>DECISION<\/p>\n<p>3. After considering the Responses and Reply, the Jury published its Decision on<br \/>\n18th December 2012 in Jury Notice JN059:<\/p>\n<p>The Jury is satisfied that OTUSA breached Protocol Article 37.2(g).<\/p>\n<p>DIRECTIONS No.2 (JN059)<\/p>\n<p>4. Jury Notice JN059 ordered that the photographs be delivered to LR and the Jury<br \/>\nby 22nd December 2012, and invited Parties to make submissions on Costs and<br \/>\nPenalty by 24th December.<\/p>\n<p>PHOTOGRAPHS<\/p>\n<p>5. On 22nd December OTUSA complied with the Directions of the Jury and provided<br \/>\n10 photographs to LR and the Jury.<\/p>\n<p>SUBMISSIONS ON PENALTY<\/p>\n<p>6. LR submitted that gathering design information was critical to OTUSA as they<br \/>\nwere unable to sail their own AC72. LR concluded that the breach by OTUSA was<br \/>\nquite deliberate and that their interpretation of the Protocol was absolutely artificial.<\/p>\n<p>LR submitted that a financial penalty would be meaningless and an appropriate<br \/>\npenalty would be the reduction of 15 sailing days in the Sailing Period 1st February<br \/>\nto 1st May 2013, together with a reduction of two daggerboards of the maximum<br \/>\nallowed limit under Protocol article 29.7 and a reduction of one wing spar of the<br \/>\nmaximum allowed limit under Protocol article 29.6.<\/p>\n<p>7. Emirates Team New Zealand (ETNZ) submitted that the breach was deliberate<br \/>\nand based on a distorted interpretation of OTUSA\u2019s own Protocol. The breach<br \/>\ngave OTUSA a significant advantage resulting from the improved quality of images<br \/>\nobtainable from within the 200m limit. ETNZ suggested that a penalty on the<br \/>\nindividual rather than the team was inappropriate as the actions were clearly<br \/>\nsanctioned by the team. ETNZ submitted that to be just and equitable a penalty<br \/>\nhas to be meaningful, and that the Jury should select from \u201cA loss of a point or<br \/>\npoints in the Match; A reduction either in the number of permitted Wing Spar<br \/>\nsections under Article 29.6 of the Protocol or in the number of permitted<br \/>\nDaggerboards under Article 29.7; A reduction in the number of the permitted<br \/>\nsailing days available to OTUSA between 1 February and 1 May 2013 under<br \/>\nArticle 29.2(e) of the Protocol; An order that no OTUSA team members or agents<br \/>\nacting on behalf of OTUSA undertake any reconnaissance activities in Auckland or<br \/>\nSan Francisco between the date of the order and the 30th April 2013 or such other<br \/>\ndate specified by the Jury.\u201d<\/p>\n<p>8. OTUSA submitted that they never set out to deliberately break Protocol Article<br \/>\n37.2(g), and that \u201ca penalty above and beyond the award of costs would not be<br \/>\nappropriate inasmuch as there was a legitimate and honest difference of opinion<br \/>\nas to the interpretation of the Protocol, the observations\/photos obtained when<br \/>\nwithin 200m are no different than can and have been obtained from outside 200m,<br \/>\nat the time the AC72 observed was not testing, training or competing, and there<br \/>\nwere no safety or harassment issues involved in the incident.\u201d<\/p>\n<p>DISCUSSION ON PENALTY<\/p>\n<p>9. OTUSA has apologised to LR and indicated that as a result of the Jury Decision<br \/>\nany team members involved with reconnaissance finding themselves in a similar<br \/>\nsituation to this incident will:<br \/>\n\u201c(a) safely manoeuvre their vessel to more than 200m from the AC72 in<br \/>\nquestion;<br \/>\n(b) not photograph or record the yacht if they may be within 200m of the AC72<br \/>\nyacht; and<br \/>\n(c) apart from what basic seamanship demands, not to observe the AC72<br \/>\nyacht from within 200m.\u201d<\/p>\n<p>10. However, the Jury finds the interpretation that OTUSA relied on to remain within<br \/>\nthe 200m limit and to continue to observe and photograph LR was both flawed and<br \/>\nunreasonable. If in doubt, OTUSA could have sought an interpretation of the<br \/>\nArticle from the Jury.<\/p>\n<p>11. The Reconnaissance Article is an important provision in the Protocol, and contains<br \/>\nexpress prohibitions with the intention of preventing the gaining of information by<br \/>\nCompetitors about other Competitors. In this case, information in the form of a<\/p>\n<p>number of photographs was obtained in breach of that Article, The benefit (if any)<br \/>\nof such information is not possible to determine but neither can it be undone.<\/p>\n<p>12. Therefore it is appropriate that a meaningful penalty be imposed.<\/p>\n<p>DECISION ON PENALTY<\/p>\n<p>13. During the Second AC72 Sailing Period (1st February 2013 to 1st May 2013)<br \/>\nas provided for in Article 29.2(e), OTUSA may not sail their AC72 yachts on the<br \/>\nfinal five consecutive days of this Sailing Period, that is 26th April to 30th April 2013<br \/>\ninclusive.<\/p>\n<p>DISCUSSION ON AWARD OF COSTS<\/p>\n<p>14. LR and ETNZ submitted that all costs should be awarded against OTUSA; OTUSA<br \/>\naccepted that it alone should bear the full costs of the case.<\/p>\n<p>COSTS AWARD<\/p>\n<p>15. In accordance with the Jury Guidelines for the Award of Costs and Expenses<br \/>\npublished on 13th August 2011, the Jury considers it is just and equitable that<br \/>\ncosts of \u20ac11,500 are awarded.
