SALES TAX

Writing this blog sometimes causes me to reflect on what should be the “story of the day”. It may be just my mood that influences my choice. The following article ,as far as I am concerned, has been one of the many elephants on the room.

Most of the countries of the world have “VAT”. They are centralized nations. In the United States, our fundamental fear of a centralized government creates a far more difficult environment to establish a unified code. Like most people I do not know the answer. I do know I do not want to pay more. Sales tax is effectively a use tax. I think I might prefer it to property tax.

Amazon and Ebay, two of the biggest names in online retail, have staked out contrary positions in a debate over the taxation of US internet shopping, which enables many buyers to escape paying sales tax.

 

The two companies are divided in the face of a lobbying challenge from bricks-and-mortar rivals including Walmart and Sears , which complain that a tax loophole gives their online rivals an unfair price advantage. The issue is being pushed up the political agenda by the weak public finances of many US states, which are struggling with budget deficits and are eager to find new sources of tax revenue.

The US does not have a federal tax law on internet commerce, but since 2008 seven states have changed their laws in an effort to makeAmazon and others collect sales tax from customers.

Amazon has fought such moves aggressively, but says it would support a federal law provided it was simple and applied even-handedly. Ebay , by contrast, remains a staunch opponent of any catch-all legislation.

The controversy has implications for cash-strapped consumers, whose shift to tax-free online shopping was accelerated by the economic downturn.

 

Credit Suisse analysts have estimated that far-reaching federal sales tax legislation could cut $653 million or 2.7 percent off Amazon’s forecast 2011 North America revenue.

In six of the states that have modified their laws, Amazon has severed its ties with local marketing affiliates to avoid being captured by the legislation.

In New York, the seventh state, it is collecting sales tax but suing to have the legislation repealed.

Jeff Bezos, Amazon’s founder and chief executive, told shareholders last week: “I believe we’ll have the simplified sales tax initiative passed [in ten years] . I hope it might happen much sooner than that.”

Ebay, by contrast, is opposed to any form of legislation that would impose taxes on small retailers, including thousands of those who sell goods on its web marketplace.

Brian Bieron, senior director for federal government affairs at Ebay, said: “We believe that putting a tax burden on small businesses and treating them the same as giant retailers is unfair. This would add a new cost.”

Several bricks-and-mortar retailers – including Walmart, Target , Sears and Best Buy – have joined a lobbying group called the Alliance For Main Street Fairness that is encour aging states to modify their laws.

Danny Diaz, a spokesman for the alliance, criticised Amazon’s position. “It is incredibly disingenuous for them to say they support a federal solution when they are battling state efforts tooth and nail. Their entire business model is based on state tax avoidance,” he said

AROUND THE ISLAND RACE

The round the island race was sailed in reverse, that is starting to the north. The results are here. We made two mistakes, almost recovering between beavertail and the finish. It was a light and shifty day. the wind moved through the entire compass and varied in strength between 3 and 12 knots.

Tomorrow we are likely to sail outside, on windward leeward courses.

NYYC SPRING REGATTA AND A NEW LOOK

If you have visited my site in the last few days; you will notice that I have changed the look of the site.

Starting on friday, “Snow Lion” will participate in the New York Yacht Club Annual Spring Regatta. A frantic weekend of sailing that signals the beginning of the summer season for the NYYC. Friday’s race is around Conanicut Island (Jamestown) which features tides and wind changes; always a fun race. Saturday and Sunday are windward leeward courses likely off newport, wind allowing.

This is very different sailing to that of the transatlantic race. We will have plenty of time to shift gears before our June 29th start.

SAFETY AT SEA HANDS ON TRAINING

Today I attended a day long “in the water training” seminar in preparation for the upcoming transatlantic race. Taught by Dan O’Connor of Life Raft and Survival. I highly recommend this course to anyone planning any sort of long distance sailing. The crew of “Phaedo” a Gunboat 66, which will also participate in the race were my fellow students. Their questions only improved the quality of the course.

This was very similar to the in the water course I attended before the Fastnet Race given in England.

DR. JACK KEVORKIAN

Jack Kevorkian’s passing, regardless of your personal feelings, was a missed opportunity for us as a civilized society. He offered us the possibility of having an ethical/legal debate on the issue of euthanasia. I considered this a squandered moment in time. The problem remains unresolved. It is not a subject that will be solved easily or quickly; and remains hanging over us. if we ever arrive at the discussion there will be no one who has given it as much thought. The debate will begin from scratch.

Dr. Jack Kevorkian, the Michigan pathologist who put assisted suicide on the world’s medical ethics stage, died early Friday, according to a spokesman with Beaumont Hospital. He was 83.

The assisted-suicide advocate had been hospitalized in Michigan for pneumonia and a kidney-related ailment, his attorney Mayer Morganroth has said.

The music of Johann Sebastian Bach, Kevorkian’s favorite musician, was put on the intercom so he could hear the music as he was dying, Morganroth said.

The 83-year-old former pathologist had struggled with kidney problems for years and had checked into a hospital earlier this month for similar problems, his lawyer, Mayer Morganroth, told CNN last month. He checked back into Beaumont Hospital in the Detroit suburb of Royal Oak on May 18 after suffering a relapse, Morganroth said.

Kevorkian, dubbed “Dr. Death,” made national headlines as a supporter of physician-assisted suicide and “right-to-die” legislation. He was charged with murder numerous times through the 1990s for helping terminally ill patients take their own lives.

He was convicted on second-degree murder charges in 1999 stemming from the death of a patient who suffered from amyotrophic lateral sclerosis, commonly called Lou Gehrig’s disease. He was paroled in 2007.

After his release, he said he would not help end any more lives.

In an interview with CNN’s Dr. Sanjay Gupta last year, Kevorkian said he had no regrets about his work.

“No, no. It’s your purpose (as a) physician. How can you regret helping a suffering patient?” he said.

In that interview, Kevorkian said that he had three missions in life and that he himself was not ready to die.

One of his missions was to warn mankind of “impending doom” that will come from the culture of overabundance.

“I’m not going to be too popular for that one,” he said.

His second mission was to educate people about assisted suicide, and his belief that in states where assisted suicide has been legalized, it is not being done right. He believed that people shouldn’t have to be terminal in order to qualify for help in ending their own lives.

Kevorkian’s third stated mission was to convince Americans that their rights are being infringed upon by bans on everything from smoking to assisted suicide.

In 2008, at the age of 79, he had a failed run for Congress in Michigan.

Morganroth told the Detroit Free Press it appears Kevorkian suffered a pulmonary thrombosis when a blood clot from his leg broke free and lodged in his heart. With Kevorkian were his niece Ava Janus and Morganroth.

“It was peaceful,” Morganroth told the paper. “He didn’t feel a thing.”
